1. Acceptance of Terms
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “user”) and Adventure With Care, LLC (“AWC,” “we,” “us,” or “our”). By accessing or using our website (www.adventurewithcare.com), purchasing any product or service, subscribing to any program, or otherwise interacting with our services (collectively, “Services”), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use of our Services immediately.
2. Eligibility
You must be at least 18 years of age to make purchases or enter into subscription agreements with AWC. You must be at least 13 years of age (or 16 in the EEA) to use our website or complete registration forms. By using our Services, you represent and warrant that you meet the applicable age requirement and have the legal capacity to enter into these Terms. If you are using our Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Description of Services
Adventure With Care, LLC provides a loyalty-based ecosystem serving the camping, RV, and outdoor community. Our Services include, but are not limited to:
- AWC Loyalty Program: A configurable membership program with bundled benefits and services including health, wellness, pet care, legal services, discount programs, and more
- Adventure Pass: An annual membership providing access to 120+ Premier RV Parks nationwide with full hookup RV sites, tent sites, and cabin rentals
- Marketing Packages: Annual marketing services for campgrounds, resorts, and RV dealerships
- Survey & Registration Platform: Digital forms for event registrations, loyalty enrollment, and partner programs
- Energy Savings: Energy cost reduction services for residential and small business customers
- Communications: Email, SMS/text messaging, and notification services
We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time with or without prior notice.
4. Accounts and Registration
When you create an account, make a purchase, or register for any AWC program, you agree to provide accurate, current, and complete information. You are responsible for maintaining the accuracy of your information, keeping your login credentials confidential, and all activity that occurs under your account. You must notify us immediately if you suspect unauthorized access to your account.
We reserve the right to suspend or terminate accounts that contain inaccurate information, are used fraudulently, or violate these Terms.
5. Purchases, Subscriptions, and Payments
5.1 Pricing and Payment
All prices are listed in U.S. dollars and are subject to change without notice. Payment is processed through our authorized payment processor(s). By making a purchase, you authorize us to charge the payment method you provide for the total amount of your order, including applicable taxes and fees.
5.2 Subscriptions and Recurring Billing
Certain AWC products and services (including Loyalty Program memberships and Adventure Passes) are sold on a subscription basis. By subscribing, you authorize AWC to charge your payment method on a recurring basis (monthly or annually, depending on the plan) until you cancel. Subscription renewals will be charged at the then-current rate.
5.3 Renewal Notifications
We will send renewal reminders and expiration warnings via email and/or SMS (if you have opted in to text messages) prior to your subscription renewal date. It is your responsibility to ensure your payment information is current and to cancel before the renewal date if you do not wish to continue.
5.4 Cancellation and Refunds
You may cancel your subscription at any time by contacting us at support@adventurewithcare.com or calling (201) 500-2289. Cancellations take effect at the end of the current billing period. Refunds are handled on a case-by-case basis at AWC’s discretion. Annual memberships (such as Adventure Passes) are generally non-refundable after 30 days of purchase.
6. SMS/Text Messaging Terms
By providing your mobile phone number and consenting to receive text messages — whether through our website, a registration form, a survey, a checkout process, or by texting a keyword to our number — you agree to the following terms:
6.1 Consent and Opt-In
By checking a consent box, completing a registration or purchase that includes SMS opt-in, or texting a keyword (such as JOIN or AWC) to our number, you expressly consent to receive autodialed or prerecorded SMS/text messages from Adventure With Care, LLC and its affiliated partners at the phone number you provided. Your consent is not a condition of any purchase, subscription, or participation in any program.
6.2 Types of Messages
You may receive the following types of text messages:
- Order confirmations, payment receipts, and shipping notifications
- Subscription renewal reminders and expiration warnings
- Survey and registration confirmations
- Offer activation codes and redemption instructions
- Loyalty program updates, rewards, points notifications, and benefit alerts
- Adventure Pass booking confirmations and campground updates
- Promotional offers and marketing communications from Adventure With Care and the partner(s) you registered or transacted with
- Event reminders, travel updates, and service notifications
- Account security alerts and verification codes
6.3 Message Frequency
Message frequency varies based on your account activity, purchases, subscriptions, registrations, and partner interactions. You may receive up to 15 messages per month. Transactional messages (order confirmations, activation codes, renewal reminders) are triggered by your actions and may be sent in addition to scheduled messages.
6.4 Message and Data Rates
Message and data rates may apply. Check with your wireless carrier for details about your text messaging plan. AWC is not responsible for any messaging or data charges from your carrier.
6.5 Opt-Out
You may opt out of receiving SMS/text messages at any time by replying STOP to any message you receive from us. You will receive a single confirmation message acknowledging your opt-out request, and no further messages will be sent unless you re-subscribe. 6.7 Carrier Disclaimer
T-Mobile, AT&T, Verizon, and all other major U.S. wireless carriers are supported. Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network operator and is outside of our control.
6.8 Phone Number Ownership
By providing your mobile number, you represent and warrant that you are the owner or authorized user of that number. You agree to notify us promptly if your mobile number changes.
7. Adventure Pass Terms
The Adventure Pass provides access to participating Premier RV Parks and campground locations. Use of the Adventure Pass is subject to the following:
- Access is subject to availability at participating locations
- Each Adventure Pass is assigned to an individual or household and is non-transferable
- Participating locations, amenities, and site types may vary and are subject to change
- You must comply with all rules, regulations, and policies of individual campgrounds and RV parks
- AWC reserves the right to revoke an Adventure Pass for misuse, fraud, or violation of campground policies
- The Adventure Pass includes one free year of AWC Loyalty Program membership
8. Loyalty Program Terms
Participation in the AWC Loyalty Program is subject to the specific terms of your membership tier and partner-specific terms. Benefits, services, and bundle components are subject to change and may vary by configuration. AWC acts as a Third-Party Administrator (TPA) and coordinates the delivery of bundled services through our network of providers. Individual service components (health services, pet services, legal services, discount programs, etc.) are subject to the terms and conditions of their respective providers.
Points, rewards, and loyalty benefits have no cash value, are non-transferable, and may expire as outlined in your membership terms.
9. Offers and Rewards
Offers, rewards, promotional codes, and discounts provided through our Services are subject to the specific terms, conditions, and expiration dates associated with each offer. AWC reserves the right to modify, suspend, or cancel any offer at any time without prior notice. Offers are non-transferable, have no cash value, and may not be combined with other promotions unless otherwise stated. Offer availability may vary by location, partner, and eligibility criteria.
10. User Conduct
You agree not to:
- Use our Services for any unlawful, fraudulent, or deceptive purpose
- Submit false, inaccurate, or misleading information
- Attempt to gain unauthorized access to our systems, accounts, or data
- Interfere with, disrupt, or overload the operation of our Services
- Use automated tools, bots, scrapers, or scripts to interact with our Services without written authorization
- Harvest, collect, or scrape personal information of other users
- Impersonate any person, entity, or AWC representative
- Use our Services in any way that violates applicable federal, state, or local laws
- Reverse engineer, decompile, or disassemble any part of our Services
11. Intellectual Property
All content, materials, trademarks, logos, trade names, graphics, images, and intellectual property displayed through our Services are owned by Adventure With Care, LLC or our licensors and are protected by applicable U.S. and international intellectual property laws. You may not copy, reproduce, distribute, modify, publicly display, or create derivative works from our content without prior written consent from AWC.
The Adventure With Care name, logo, and all related marks are trademarks of Adventure With Care, LLC.
12. User-Generated Content
If you submit reviews, comments, feedback, testimonials, or other content to AWC, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, publish, and distribute that content in connection with our Services and marketing. You represent that any content you submit does not violate any third-party rights.
13. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF OUR SERVICES IS AT YOUR OWN RISK.
AWC IS NOT A MEDICAL PROVIDER OR MEDICAL DEVICE AND IS NOT INTENDED TO BE USED IN THE DIAGNOSIS, CURE, MITIGATION, TREATMENT, OR PREVENTION OF ANY DISEASE OR MEDICAL CONDITION. ANY HEALTH-RELATED SERVICES INCLUDED IN OUR LOYALTY BUNDLES ARE PROVIDED BY INDEPENDENT THIRD-PARTY PROVIDERS AND ARE SUBJECT TO THEIR OWN TERMS AND LIMITATIONS.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVENTURE WITH CARE, LLC AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE OUR SERVICES, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE). OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO AWC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
15. Indemnification
You agree to indemnify, defend, and hold harmless Adventure With Care, LLC and its owners, members, officers, employees, agents, partners, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney’s fees) arising out of or related to: (a) your use of our Services; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit through our Services.
16. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or your use of our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of New Jersey.
BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
17. Termination
We may suspend or terminate your access to our Services at any time, with or without cause, and with or without notice. Upon termination, your right to use our Services will immediately cease. Any paid subscriptions or memberships will be handled in accordance with the cancellation terms in Section 5.4. Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property, disclaimers, limitations of liability, indemnification, and governing law.
18. Force Majeure
AWC shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to natural disasters, acts of government, pandemic, war, terrorism, labor disputes, power failures, internet outages, or carrier disruptions.
19. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Adventure With Care, LLC regarding your use of our Services and supersede all prior agreements, understandings, representations, and communications, whether written or oral.
21. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page and, where appropriate, notify you via email or a notice on our website. Your continued use of our Services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
